This is an appeal from a district court decision which upheld a magistrates order denying a motion to modify the child support provision of a divorce decree. Two principal issues are raised: (1) whether the trial court should refuse to consider a motion to modify a child support order because the movant is in arrears in the payment of support; and (2) whether the court should relieve a parent from paying child support when the parents ability to pay has been reduced because the parent is incarcerated in the penitentiary on a criminal offense. We vacate, in part, the district courts decision upholding the magistrates order, and we remand this case for further consideration by the magistrate.
